Mahatma Rice Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW. THIS Sweepstakes IS IN NO WAY SPONSORED, ADMINISTERED OR ENDORSED BY, OR AFFILIATED WITH INSTAGRAM.

  1. ELIGIBILITY: The Sweepstakes is only open to legal residents of the 50 United States, Puerto Rico and District of Columbia who are at least eighteen (18) years of age or older at the time of entry. Employees, contractors, officers, directors and agents of Riviana Foods Inc. (“Sponsor”), its affiliates, subsidiaries and advertising or promotion agencies (collectively the “Promotion Parties”), and immediate family members (defined as including spouse, biological, adoptive and step- parents, grandparents, siblings, children and grandchildren and each of their respective spouses, regardless of where they reside) and/or those living in the same household (whether related or not) of Promotion Parties and their employees and any individual who has been awarded a prize in any promotion sponsored by Riviana Foods Inc. in the past 12 months measured from the date of entry are not eligible to participate in the Sweepstakes. Void outside the 50 United States, Puerto Rico and D.C. and where prohibited or otherwise restricted by law. Winning a Prize is contingent upon fulfilling all requirements set forth herein. Subject to all applicable federal, state, and local laws and regulations.
  2. TIMING: Beginning at 8:00:01 AM Eastern Standard Time on November 11, 2024, through 11:59:59 PM Eastern Standard Time on November 22, 2024 (the “Sweepstakes Period”), entrants must take the following actions to receive one (1) entry into the Sweepstakes. Entries received before or outside of the Sweepstakes Period will not be eligible to win the stated Prize (as defined below). Sponsor’s clock is the official clock for the Sweepstakes.

PARTICIPATION REQUIREMENTS: You must have a personal Instagram account to participate in this Sweepstakes. You may not use a corporate or shared Instagram account.  If you do not have an Instagram account, you can make one for free at Instagram.com (“Social Account”).  When you create a Social Account, you indicate that you have read and agree to accept the Terms of Use and Privacy Policy for the Social Account.  If you use your wireless mobile device to enter, standard message and data rates may apply.  Please consult your wireless-service provider regarding its pricing plans prior to entering via your wireless mobile device.  None of the Promotion Parties shall be responsible for any message or data rate charges which may apply. A wireless mobile device is not required to enter the Sweepstakes.

ENTRY REQUIREMENTS: During the Sweepstakes Period undertake the entry actions specified to receive one (1) Sweepstakes entry (“Entry”): To participate, follow Mahatma’s Instagram account and like and tag two (2) friends in their last post on the Mahatma Instagram account mentioning the Sweepstakes.

Upon satisfactorily completing the foregoing actions (at Sponsor’s discretion), an eligible individual is deemed an “entrant” for purposes of the Sweepstakes and will receive one (1) Entry into the Sweepstakes subject to these Official Rules. You must keep the Instagram handle you used to enter through the time when the prize is awarded (as described in Section 3 below).  Failure to comply with any of the above requirements or the Official Rules will result in disqualification of you and your Entry.

  1. PRIZE: Two (2) winners (“Winners”) will be selected. The first (1st) winner will receive one (1) food steamer, one (1) 360 induction rice & grain multicooker one (1) turbo convection air oven, one (1) Whatever Pot all from Aroma and one (1) Stainless Steel Wok (the “Prize”). The second (2nd) winner will receive one (1) food steamer, one (1) 360 induction rice & grain multicooker and one (1) turbo convection air oven. The sponsor (in its sole discretion) reserves the right to substitute a Prize of equal or greater value if the advertised Prize becomes unavailable. The Prize is non-transferable. All federal, state, and/or local taxes and any expenses related to or resulting from acceptance and use of the Prize, if any, shall be the sole responsibility of Winner. Prize consists of only those items specifically stated as part of the Prize. All expenses and costs associated with the acceptance or use of the Prize that are not expressly specified in these Official Rules as being part of the Prize are the sole responsibility of the Winner. No substitution or transfer/assignment or exchange of Prize to others or request for the cash equivalent by a Winner is permitted. The prize will be completed by mail within approximately 8-10 weeks following the conclusion of the Sweepstakes Period and verification of Winner’s eligibility and compliance with these Official Rules.

Total approximate retail value of the 1st Prize: $420.00, and for the 2nd Prize: $280.00.

Winner acknowledges that Promotion Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose.  Any and all warranties and/or guarantees on a Prize (if any) are subject to the respective manufacturers’ terms therefore, and the Winner agrees to look solely to such manufacturers for any such warranty and/or guarantee.

  1. ODDS: The odds of winning depend on the number of eligible Entries received during the Sweepstakes Period and that qualify as described below in Section 5.
  2. SWEEPSTAKES JUDGING AND NOTIFICATION: Planit (“Administrator”) will select the potential Sweepstakes Winners by random dram from among all eligible Entries received during the Sweepstakes Period on or around November 25, 2024. The Administrator’s decisions as to the administration and operation of the Sweepstakes, including but not limited to the selection of the potential Winners, are final and binding. A PARTICIPANT IS NOT A WINNER OF THE PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY AND COMPLIANCE WITH THE OFFICIAL RULES HAVE BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. The potential Winners will be notified by via Instagram Direct Message on the Social Account used to enter within five (5) days following the drawing and will be directed to provide first name, last name, email address @mahatmariceusa and home mailing address and confirm their age within three (3) days of the date of notice in order to claim the Prize. If: (a) the potential Winners cannot be contacted, is ineligible, or fails to provide any requested information within the required time period, (b) a Prize/Prize notification is returned as undeliverable, or (c) the potential Winners does not comply with these Official Rules in any way, the potential Winners will be disqualified and will forfeit the Prize. Failure to comply with any term or condition in these Official Rules may result in disqualification at Sponsor’s sole discretion. If the potential Winners forfeits the Prize or is disqualified for any reason, Sponsor may award the Prize to an alternate potential Winners. Sponsor may limit the number of attempts to award a Prize to two (2) attempts.
  3. RIGHTS GRANTED BY YOU: By entering the Sweepstakes, you understand and agree that, and grant to, Sponsor and Promotion Parties, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, the perpetual right, license and consent, where permitted by law, to use and refer to the participant, print, publish, broadcast, distribute, reproduce and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your Entry, name, city, state, Instagram handle and statements about the Sweepstakes, for news, publicity, information, trade, advertising, public relations, editorial, and promotional purposes without any compensation to you or notice, review, consideration, further notification or consent from you. If requested, Entrant will sign and return a publicity release, and such other documents as may be required pursuant to these Official Rules. For uses beyond the consent that you grant above, you agree that Sponsor’s use of your personal data will be governed by the Sponsor Privacy Policy.
  4. GENERAL RULES: By entering this Sweepstakes or accepting a Prize, entrants accept and agree to these Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes. Any Entry which, in the sole opinion of the Sponsor, is deemed to be inappropriate for publication or inclusion in the Sweepstakes for any reason, will be disqualified. If, in the opinion of Sponsor, there is any suspected evidence of tampering with any portion of the Sweepstakes that may compromise the integrity of the Sweepstakes or any virus, bug, non-authorized human intervention, fraud or other cause beyond Sponsor’s control that affects the administration, security, fairness or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. In such a case, Sponsor may select the Winner from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Use of any robotic, automatic, programmed or similar Entry method will void your Entry and result in disqualification. Any attempt by any individual to exceed the above-indicated Entry limit by using multiple/different e-mail or IP addresses, Instagram accounts, identities, or any other methods will void that individual’s Entry(ies) and that individual will be disqualified from the entire Sweepstakes. All Entries must be received during the Sweepstakes Period.  In the event of dispute as to the identity or eligibility of a potential Winner, the winning Entry will be declared to be made by the “Authorized Account Holder” of the Instagram account used to enter the Sweepstakes provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is the natural person assigned to a social media account by an Internet access provider, online service provider or other organization responsible for assigning social media accounts for the domain associated with the email address used to register the Instagram account. The potential Winner may be required to show proof of being the Authorized Account Holder of the Instagram account associated with the winning Entry.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

  1. RELEASE AND LIMITATIONS OF LIABILITY: By participating in this Sweepstakes, all entrants agree that Sponsor, Administrator, Instagram Inc., and their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, Instagram, web site providers, web masters, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, by any of the equipment or programming associated with or utilized in the Sweepstakes, or by the Instagram social media platform; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the Entry process or the Sweepstakes; or (d) technical or human error which may occur in the administration of the Sweepstakes. BY PARTICIPATING IN THE SWEEPSTAKES, ALL ENTRANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS FOR ANY AND ALL LIABILITY FOR ANY ILLNESS, INJURY, DEATH, LOSS, LITIGATION, CLAIM, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, WHETHER CAUSED BY NEGLIGENCE OR NOT, FROM: (I) ENTRY OR PARTICIPATION IN THE SWEEPSTAKES, (II) ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE OR ANY PORTION THEREOF; (III) ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY OR PRIZE DELIVERY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OF EXCLUSIONS MAY NOT APPLY.

WITHOUT LIMITING THE FOREGOING, TO THE EXTENT ALLOWED BY APPLICABLE LAW EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  1. GOVERNING LAW, DISPUTE RESOLUTION, ORDER OF PRECEDENCE, SEVERABILITY: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF THE ENTRANT AND SPONSOR IN CONNECTION WITH THE SWEEPSTAKES OR THE PRIZE, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, WITHOUT RESPECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES (WHETHER OF THE STATE OF TEXAS OR ANY OTHER JURISDICTION), WHICH WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF TEXAS. As a condition of participating in the Sweepstakes, except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or with the Prize, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of Texas or the appropriate Texas state court located in Harris County, Texas; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances shall entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim indirect, punitive, incidental, and consequential damages and any other damages, including but not limited to reasonable attorney’s fees, other than for actual out-of-pocket expenses (i.e. costs associated with entering the Sweepstakes), and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials or notifications and these Official Rules, these Official Rules shall prevail, govern and control. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed as if the invalid or illegal provision were not contained herein.
